Terms of Service

If you create an account for a brokerage or organization, you're confirming that you have the authority to bind that organization ("Customer") to these Terms, and "you" refers to both you and the Customer.

BrokerCircle is a customer relationship management platform for real estate brokerages, covering leads, contacts, property listings, matching, deals, tasks, and related workflows, accessible via the web app and the BrokerCircle mobile app. We may add, change, or remove features over time.

You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@brokercircle.in if you suspect unauthorized access. Brokerage administrators are responsible for managing which team members have access and what permissions they hold.

BrokerCircle offers a free trial period as described on our pricing page. After the trial, or if you choose a paid plan, continued use requires an active subscription. Subscription fees are billed as described at checkout and processed through Razorpay. Fees are non-refundable except as required by law or as we otherwise state in writing. We may change our pricing with advance notice to active subscribers.

As between BrokerCircle and the Customer, the Customer owns all data it enters into the Service about its own leads, contacts, properties, and deals ("Customer Data"). You grant BrokerCircle a limited license to host, process, and display Customer Data solely to provide the Service to you. You're responsible for having the necessary rights and consents to submit Customer Data — including personal information about leads, contacts, and tenants — into BrokerCircle, and for your own compliance with data protection laws that apply to how you collect and use that information.

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to other brokerages' data or accounts; upload malicious code; reverse-engineer or attempt to extract the Service's source code except as permitted by law; use the Service to send unsolicited communications in violation of applicable law; or interfere with the Service's normal operation, including through excessive automated requests.

The Service integrates with third-party providers, including Razorpay (payments), Exotel (calling/messaging), and Expo (mobile push notifications). Your use of features built on these integrations is also subject to those providers' own terms where applicable. We're not responsible for the acts or omissions of third-party providers.

BrokerCircle and its licensors retain all rights, title, and interest in the Service, including its software, design, and BrokerCircle's name and logo. These Terms don't grant you any rights to our trademarks or branding except as needed to use the Service as intended.

Each party may access confidential information of the other in connection with the Service. Each party agrees to protect the other's confidential information with the same degree of care it uses for its own similar information, and not less than reasonable care, and to use it only for purposes of the relationship between the parties.

The Service is provided "as is" and "as available." To the maximum extent permitted by law, BrokerCircle disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or that property matches or other automated suggestions will be accurate or complete — BrokerCircle is a tool to support your work, not a substitute for your own professional judgment.

To the maximum extent permitted by law, BrokerCircle will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

You may cancel your subscription at any time. We may suspend or terminate access to the Service if you materially breach these Terms and don't cure the breach after notice, or if required by law. On termination, your right to access the Service ends; we'll retain Customer Data for a reasonable period as described in our Privacy Policy to allow for export or account recovery, unless you request earlier deletion.

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in India.

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes, we'll provide notice (such as an in-app notice or email to account administrators) before the changes take effect.
